OpenBulk operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a shopping experience (the “Services”). OpenBulk is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.

Personal Information We Collect or Process

When we use the term “personal information,” we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details, including your name, billing address, shipping address, phone number, and email address.
  • Payment and transaction details, including payment method, payment confirmation, transaction details, and other information needed to process or administer a payment. Payment card details may be processed by Shopify and payment service providers.
  • Account information, including information associated with your customer account, sign-in information, profile details, and account settings.
  • Order and transaction information, including products you view, add to your cart, or purchase, your order history, and related returns, exchanges, cancellations, and other transaction details.
  • Communications with us, including information you include when you contact customer support or otherwise communicate with us.
  • Device information, including information about your device, browser, network connection, IP address, and other identifiers.
  • Usage information, including information about how and when you interact with or navigate the Services.

Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you, including when you create or use a customer account, place an order, communicate with us, or otherwise provide information.
  • Automatically through the Services, including from your device when you use the Services or visit our website, and through cookies and similar technologies, subject to your applicable privacy choices and settings.
  • From our service providers, including when they provide technology or other services to us or process information on our behalf.
  • From Shopify and other third parties, as permitted by applicable law and described in this Privacy Policy.

How We Use Your Personal Information

Depending on how you interact with us or which Services you use, we may use personal information for the following purposes:

  • Provide and administer the Services. We use personal information to process payments and orders, fulfill purchases, arrange shipping, provide order and shipping updates, manage customer accounts, allow customers to view their order information and order status, handle customer service requests and applicable returns or exchanges, and maintain our business relationship with you.
  • Maintain, protect, and improve the Services. We may use information to troubleshoot issues, understand how the Services are used, maintain site functionality, and detect or prevent fraud, abuse, security incidents, or other unauthorized activity. Shopify may also process information as described in the “Relationship with Shopify” section below.
  • Communicate with you. We use your information to respond to inquiries and send non-promotional communications about your account, orders, payments, shipping, or customer service.
  • Marketing and public promotion. We may promote OpenBulk and its products through public posts on social media platforms such as X and Instagram. We do not currently plan to send promotional marketing emails, text messages, or postal mail, or to run our own paid advertising campaigns using personal information collected through the Services. Separately, because Shopify Network Intelligence is enabled for this store, Shopify may process information about interactions with our Store, other merchants, and Shopify to provide Enhanced Services, which may include personalization and ad-targeting features. See “Relationship with Shopify” and “Your Rights and Choices” below.
  • Legal reasons. We may use personal information to comply with applicable laws, regulations, legal processes, or lawful government requests; enforce our terms and policies; resolve disputes; and protect our rights, Services, customers, or others.

How We Disclose Personal Information

In certain circumstances, we may disclose personal information to third parties for legitimate purposes, subject to this Privacy Policy and applicable law. These circumstances may include:

  • Shopify and service providers. We disclose information to Shopify and to vendors or service providers that help us operate the Services, such as payment processing, website hosting, information technology, customer support, and shipping or delivery services.
  • Shopify Enhanced Services. Shopify Network Intelligence is enabled for this store. As described below, Shopify may use information about your interactions with our Store together with information from other merchants and Shopify to generate insights and provide Enhanced Services. These services may include improved personalization, store performance, and advertising-related features. Other merchants cannot access your individual store data through Shopify Network Intelligence. Depending on where you live, you may have the right to opt out of certain uses of your personal information for “sale,” “sharing,” or targeted advertising under applicable law. You can exercise applicable opt-out choices here: Do Not Sell or Share My Personal Information.
  • At your direction or with your consent. We may disclose information when you direct us to do so, ask us to do so, or consent to the disclosure.
  • Business transfers and legal purposes. We may disclose information in connection with an actual or proposed business transaction, to comply with applicable legal obligations or lawful requests, to enforce our terms and policies, or to protect or defend the Services, our rights, or the rights of others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit to the Services may be transmitted to and shared with Shopify and third parties, including service providers that may be located in countries other than where you reside, in order to provide the Services.

Shopify Network Intelligence is enabled for this store. When it is enabled, Shopify may securely use information about your interactions with our Store together with information from other merchants and Shopify to generate insights and provide advanced features known as “Enhanced Services.” These services can help improve products and personalization, store performance, and advertising targeting. We do not currently run our own paid advertising campaigns using personal information collected through this Store; however, Shopify’s processing for Enhanced Services may include advertising-related uses, subject to applicable law and your privacy choices. Other merchants cannot access your individual store data through Shopify Network Intelligence.

Depending on your location, you may be able to opt out of certain uses of your information through the store’s data-sharing opt-out page linked above, through Global Privacy Control (GPC), or through Shopify’s privacy portal. To learn more about how Shopify processes personal information and the rights that may be available to you, please review the Shopify Consumer Privacy Policy and visit the Shopify Privacy Portal.

Third-Party Websites and Social Media

The Services may include links to websites or online platforms operated by third parties. We may also promote OpenBulk and its products through public social media posts, including on platforms such as X and Instagram. If you follow a link to, visit, or interact with a third-party platform, that platform may collect and process information about you under its own privacy policy and terms. We do not control and are not responsible for the privacy, security, or practices of third-party websites or platforms. Information you share publicly or semi-publicly on a third-party platform may be viewable by other users and may be used by that platform or others in accordance with their policies. The inclusion of a link does not, by itself, imply endorsement of that platform or its operator.

Children's Data

The Services are intended for a general audience of Pokémon card collectors, hobbyists, and businesses, and are not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If we become aware that we have collected personal information directly from a child under 13 without legally required parental consent, we will take appropriate steps to delete that information. If you believe that a child under 13 has provided personal information to us, please contact us using the details below.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we “sell” or “share” (as those terms are defined under applicable law) personal information of individuals under 16 years of age.

Security and Retention of Your Information

No security measure is perfect or impenetrable, and we cannot guarantee perfect security. Information you send to us may not be secure while in transit. Please avoid sending sensitive or confidential information through unsecured channels.

How long we retain personal information depends on factors such as whether we need it to maintain your account, provide the Services, complete transactions, comply with legal obligations, resolve disputes, or enforce our agreements and policies.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. These rights are not absolute, may apply only in certain circumstances, and may be limited as permitted by law.

  • Right to access or know. You may have the right to request access to personal information we hold about you.
  • Right to delete. You may have the right to request that we delete personal information we maintain about you.

  • Right to opt out of sale, sharing, or targeted advertising. Depending on where you live, you may have the right to opt out of the “sale” or “sharing” of personal information or of processing for “targeted advertising,” as those terms are defined by applicable privacy laws. You can exercise applicable opt-out choices here: Do Not Sell or Share My Personal Information. Where applicable, we will honor Global Privacy Control (GPC) signals as described by Shopify’s privacy settings. To learn more about GPC, visit Global Privacy Control. We do not recognize other “Do Not Track” browser signals unless required by applicable law.
  • Communication preferences. We may send non-promotional communications related to your customer account, orders, shipping, payments, or customer service. These messages are necessary to provide the Services and are not promotional marketing messages.

You may exercise applicable rights through the tools made available in the Services or by contacting us using the contact details below. To learn more about privacy rights relating to data processed by Shopify, you can visit the Shopify Privacy Portal.

We will not discriminate against you for exercising rights available to you under applicable privacy laws. We may need to verify your identity before processing a request. Your personal information may be transferred to, stored in, or processed in a country other than the country where you live, including countries where Shopify or our service providers operate. Privacy and data protection laws in those countries may differ from the laws where you live. Where required by applicable law, we will use appropriate measures for international transfers.
