Terms of service

Last updated: October 22, 2026

Overview

Welcome to OpenBulk. The terms “we,” “us,” and “our” refer to OpenBulk. OpenBulk operates this store and website, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”). The Services are powered by Shopify, which provides the technology used to operate our store.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, including the provisions concerning warranties and limitations of liability.

By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use or access the Services. Nothing in these Terms limits any rights that cannot be waived under applicable consumer protection laws or other mandatory law.

1. Access and account

By agreeing to these Terms, you represent that you are at least the age of majority where you live. If you permit a minor dependent to use the Services on a device you own, purchase, or manage, you are responsible for that use to the extent permitted by law.

You may be asked to provide information such as your email address, billing information, payment information, and shipping address to browse, create an account, or place an order. You agree that all information you provide is accurate, current, and complete, and that you are authorized to provide it. You are responsible for maintaining the security of your account credentials and for activity under your account. You may not sell, transfer, assign, or license your account to another person.

2. Our products

We make reasonable efforts to describe and display products accurately. Colors and appearance may vary depending on your display and device settings. Product listings will describe the relevant contents and characteristics of each product. For bulk trading-card assortments, the exact cards and mix may vary; unless the listing expressly states otherwise, we do not guarantee any particular card, set, duplicate count, market value, third-party grading result, or future resale value. Any stated card count, rarity, language, condition range, exclusions, or other product specification in the listing applicable when you place your order forms part of the product description.

Descriptions and availability may be updated for future purchases. A change made after you place an order will not alter the description applicable to that order, except as permitted by applicable law. We may discontinue products or set reasonable quantity, destination, or jurisdiction restrictions, subject to applicable law.

3. Orders

When you place an order, you make an offer to purchase the items in your order and authorize us and our payment processors to charge your selected payment method for the total shown at checkout. We may accept or decline an order, or cancel an order where permitted by law, including when an item is unavailable, a listing or pricing error occurs, payment cannot be authorized, or we reasonably suspect fraud or an unauthorized transaction. An order is accepted when we send an order confirmation or otherwise expressly confirm acceptance. We may contact you using the details you provided if an order is changed or canceled. If we cancel an order after payment, we will issue any refund required by applicable law.

You may purchase products for personal use or for lawful business purposes, including resale of the physical cards where permitted by applicable law. You are responsible for ensuring that your own resale, business, and import activities comply with the laws and requirements applicable to you. A purchase does not imply that OpenBulk is affiliated with or endorsed by any third-party brand or rights holder.

Please review your order carefully before submitting it. Cancellation requests after acceptance may not be possible, except where required by our Return and Refund Policy or applicable law. Returns and refunds are handled under our Return and Refund Policy, which does not limit rights that cannot be waived by law.

4. Prices and billing

The price charged is the price displayed at the time you place your order and confirmed in your order confirmation. Prices, discounts, and promotions may change for future orders. Unless expressly stated otherwise, prices do not include shipping, handling, applicable sales or other taxes not collected at checkout, import duties, tariffs, customs clearance charges, carrier brokerage fees, or other import-related charges.

Any applicable tax or shipping charge collected by us will be shown at checkout. Import duties, tariffs, customs charges, brokerage fees, and similar amounts not collected at checkout are generally the buyer’s responsibility and may be assessed by the relevant authorities or carrier. Import requirements and fees can change; please check the rules applicable to your destination. If a promotion has separate terms, those terms apply to the extent of any conflict with these Terms.

You agree to provide accurate, current, and complete purchase, payment, and account information and to update it when needed. You represent that you are authorized to use the payment method provided, that the payment information is accurate, and that you will pay the amounts shown at checkout, including applicable taxes and shipping charges.

5. Shipping and delivery

Shipping methods, estimated dispatch times, and estimated delivery times are described at checkout or in our Shipping Policy. Delivery estimates are not guarantees, because carrier handling, customs processing, and events beyond our reasonable control may affect delivery. We will comply with applicable law if we cannot ship within a stated or otherwise legally required time, including providing delay notices, obtaining consent to a delay where required, or issuing a refund where required.

Unless applicable law requires otherwise, we are not responsible for delays caused by carriers, customs authorities, severe weather, natural disasters, labor disputes, supply shortages, utility or telecommunications interruptions, cyber incidents, governmental actions, or other events beyond our reasonable control. Title to products and risk of loss pass as provided by applicable law and any express delivery terms disclosed for the order. Nothing in this section removes any non-waivable rights you may have under applicable law. Please see our Shipping Policy for additional details.

6. Intellectual property

The original text, graphics, site design, and other content created by OpenBulk for the Services are owned by OpenBulk or licensed to us and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, or commercially exploit our website content without our prior written permission, except as permitted by law.

Product names, third-party trademarks, trading-card artwork, character names, logos, and other third-party intellectual property remain the property of their respective rights holders. Pokémon and related names, artwork, characters, and marks are not owned by OpenBulk. OpenBulk is an independent seller and is not affiliated with, sponsored by, or endorsed by Nintendo, Creatures, GAME FREAK, The Pokémon Company, or The Pokémon Company International, unless we expressly state otherwise.

Buying a physical card gives you ownership of that physical item, subject to applicable law, but does not transfer copyright, trademark, or other intellectual property rights in the card artwork, characters, brands, or other underlying content. Nothing in these Terms prevents you from reselling physical cards you lawfully purchase where resale is permitted by applicable law; however, you may not use any third-party intellectual property or OpenBulk branding in a way that infringes rights or falsely suggests an affiliation, sponsorship, or endorsement.

OpenBulk’s name, logo, and any original OpenBulk marks may not be used without our prior written permission. Shopify’s name and logo are trademarks of Shopify. Other names, logos, and product or service marks appearing in the Services belong to their respective owners.

7. Optional tools

The Services may provide access to tools or features operated by third parties. Unless we expressly state otherwise, those tools are provided by their respective providers, and we do not control or endorse them. To the extent permitted by applicable law, third-party tools are made available on an “as is” and “as available” basis, and your use of them is at your own discretion. You should review the applicable provider’s terms and policies. New features or tools added to the Services will also be subject to these Terms unless stated otherwise.

8. Third-party links

The Services may contain links to or embedded features from third-party websites or services. We do not control and are not responsible for the content, policies, availability, or practices of third-party websites. If you access a third-party website, you do so at your own risk and should review its terms and privacy practices. Questions or disputes about third-party products or services should be directed to the relevant third party.

9. Relationship with Shopify

The Services are powered by Shopify. However, purchases made in this store are transactions between you and OpenBulk. To the extent permitted by applicable law, Shopify is not the seller of products purchased from OpenBulk and is not responsible for the sale between you and OpenBulk. Nothing in these Terms excludes or limits any responsibility or right that cannot be excluded or limited under applicable law.

10. Privacy policy

Our Privacy Policy explains how we collect, use, and disclose personal information in connection with the Services. By using the Services, you acknowledge that you have read the Privacy Policy. Because the Services are hosted by Shopify, Shopify and its service providers may collect, process, and store information about your access to and use of the store, including transaction and browsing information, as described in our Privacy Policy and Shopify’s privacy policy: https://www.shopify.com/legal/privacy/app-users.

11. Feedback

If you voluntarily submit ideas, suggestions, or other feedback about the Services (“Feedback”), you grant OpenBulk a worldwide, royalty-free license to use, reproduce, modify, publish, and display that Feedback to operate, improve, and promote the Services, subject to applicable law. You represent that you have the rights necessary to submit the Feedback and that it does not violate another person’s rights or applicable law. We are not required to keep Feedback confidential, pay compensation for it, or respond to it. We may remove Feedback that we reasonably believe violates these Terms or applicable law. You remain responsible for Feedback you submit.

12. Errors, inaccuracies, and omissions

Information on the Services may occasionally contain typographical errors or inaccuracies relating to product descriptions, prices, promotions, shipping charges, transit times, or availability. We may correct errors and update information. If an error materially affects an order, we may contact you to explain the issue and, where permitted by law, cancel or adjust the order. If an order is canceled after payment, we will issue any refund required by applicable law.

13. Prohibited uses

13.1 You may use the Services only for lawful purposes. You may not use the Services to violate applicable laws or regulations; infringe intellectual property or other rights; harass, threaten, or harm another person; submit false or misleading information; distribute unlawful, defamatory, obscene, or otherwise prohibited material; send spam or unauthorized solicitations; impersonate another person or entity; or interfere with another person’s use of the Services.

13.2 You also agree not to upload or transmit malicious code; disrupt or damage the Services; collect personal information about other users without authorization; engage in phishing, spamming, or similar abusive conduct; scrape, extract, copy, or systematically collect content or data from the Services using bots, spiders, scrapers, or other automated means without our written permission; or circumvent security, access controls, or other measures used to protect the Services. Any automated agent must also comply with Section 14. We may suspend or terminate an account if we reasonably determine that the user has materially violated these Terms, subject to applicable law.

14. Agents

14.1 This section applies to any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity to access, use, or interact with the Services (“Agent”).

14.2 An Agent may access or interact with the Services only if it identifies itself and complies with this section. We may ask an Agent to stop accessing or interacting with the Services, and the Agent must comply with that request.

14.3 We may limit, including through technical measures, whether and how an Agent accesses, uses, or interacts with the Services.

14.4 Agents must: (a) identify themselves in HTTP/HTTPS requests and disclose the Agent’s name in the user-agent string, using “Agent/[agent name]” where technically applicable; (b) not disguise automated activity as human activity or circumvent CAPTCHAs or other measures intended to distinguish automated access from human access; (c) respond truthfully when asked whether access is automated; and (d) not bypass measures intended to block, limit, or control Agent access.

15. Termination

We may suspend or terminate your access to the Services where permitted by law, including if you materially violate these Terms or use the Services in a fraudulent, abusive, or unlawful way. Termination does not remove your obligation to pay amounts properly due for accepted orders. Provisions that by their nature should survive termination will continue to apply, including those concerning intellectual property, Feedback, disclaimers, limitation of liability, indemnification, governing law, privacy, and interpretation.

16. Disclaimer of warranties

Information on the Services is provided for general informational purposes. We make reasonable efforts to keep it accurate, but do not guarantee that all website information will always be complete, current, or error-free.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND THIRD-PARTY TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF AVAILABILITY, UNINTERRUPTED ACCESS, OR ERROR-FREE OPERATION. PRODUCT CONTENTS, CONDITION, AND OTHER CHARACTERISTICS ARE DESCRIBED IN THE APPLICABLE PRODUCT LISTING. NOTHING IN THESE TERMS DISCLAIMS AN EXPRESS PRODUCT DESCRIPTION OR ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OPENBULK AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless OpenBulk and its service providers from third-party claims, losses, and reasonable expenses arising from your material breach of these Terms, your violation of applicable law or another person’s rights, or your misuse of the Services. We will provide reasonable notice of a claim for which indemnification is sought and will not agree to a settlement that imposes a non-monetary obligation on you without your consent, not to be unreasonably withheld. You agree to reasonably cooperate in the defense of such a claim.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary. The remaining provisions will remain in effect. Nothing in these Terms limits rights under applicable consumer protection laws or other laws that cannot be waived by contract.

20. Waiver; entire agreement

Our failure to enforce a provision of these Terms is not a waiver of that provision. These Terms, together with the policies referenced in them and any terms expressly presented to you at checkout, form the agreement between you and OpenBulk concerning the Services and supersede prior agreements on the same subject. If a promotion has separate terms, those terms apply to that promotion to the extent of any conflict. Nothing in this section overrides mandatory rights under applicable law.

21. Assignment

You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent, except where such restriction is prohibited by law. We may assign or transfer our rights and obligations in connection with a business transfer or operation of the Services, subject to applicable law.

22. Governing law

These Terms are governed by the laws of Japan, without regard to its conflict-of-law principles, except to the extent that mandatory consumer protection laws of another jurisdiction apply to you and cannot lawfully be excluded. To the extent permitted by applicable law, disputes may be brought before a court with jurisdiction over OpenBulk in Japan. Nothing in this section deprives you of any right to bring a claim in another court or rely on mandatory law where applicable law gives you that right.

23. Language

These Terms are written in English. If we provide a translation, the English version will govern to the extent permitted by applicable law. The language and procedure of any court or regulatory proceeding will be determined by the rules applicable to that proceeding.

24. Headings

Headings are included for convenience only and do not affect the interpretation of these Terms.

25. Electronic communications

By using the Services or placing an order, you agree that we may send transactional and service-related communications electronically, including by email, account notifications, or notices posted on the Services. These communications may relate to your orders, account, purchases, returns, these Terms, or other matters concerning the Services. You are responsible for keeping your contact information current.

26. Changes to these Terms

You can review the current version of these Terms on this page. We may update these Terms by posting a revised version on the website. Changes will take effect on the date stated in the revised Terms or accompanying notice, subject to applicable law. Unless required by law or expressly agreed otherwise, changes will apply to future use of the Services and orders placed after the effective date, not retroactively to an accepted order. We will provide notice of material changes when required by law.
